1. Agreement to Terms

By accessing or using Cool English Music at music.coolenglish.org ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Cool English Music provides interactive ESL/EFL activities for English language learning. The Service includes song-based activities: full songs, song clip games, music video clips and vocals-only tracks. Content is accessible through web browsers with both free and premium options.

3. User Accounts

• You must provide accurate and complete registration information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• One person per account unless using a team subscription

4. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Share account credentials with others (except team accounts)
• Attempt to bypass payment or access restrictions
• Reverse engineer or copy our content
• Use automated systems to access the Service
• Interfere with or disrupt the Service
• Collect or harvest user information
• Use the Service for commercial purposes without permission

5. Subscriptions and Payment

Billing

• Individual Plan: $5/month or $50/year
• Team Plan: $3.50/seat/month or $36/seat/year (2-49 seats)
• Subscriptions auto-renew unless cancelled
• Prices may change with 30 days notice
• All fees are in USD unless otherwise stated
• Payments are processed securely by Stripe

Cancellation

You may cancel your subscription at any time through your account dashboard or the Stripe billing portal. Access continues until the end of the current billing period. No partial refunds for unused time.

6. Refund Policy

We offer a 7-day money-back guarantee for first-time subscribers. Contact us within 7 days of your initial purchase for a full refund. After this period, refunds are considered on a case-by-case basis. Team subscriptions may have different refund terms.

7. Intellectual Property

All content, features, and functionality are owned by Cool English LLC and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

8. User Content

By submitting content to the Service (such as feedback or suggestions), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute such content in connection with the Service.

9. Educational Use

Teachers may use the Service in classroom settings according to their subscription type. Individual subscriptions are for single-teacher use. Team subscriptions allow multiple teachers within the same institution. Teachers may share activities with students using our share link feature, which provides temporary access without requiring student accounts.

10. Student Access

Teachers with active subscriptions may share activities with their students via time-limited share links. These links expire after 30 days. Students accessing content through share links are subject to these Terms but are not required to create accounts.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We make no guarantees about the educational outcomes from using our activities.

12. Limitation of Liability

To the fullest extent permitted by law, Cool English LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service, including but not limited to loss of data, revenue, or educational opportunities.

13. Indemnification

You agree to indemnify and hold harmless Cool English LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) resulting from your breach of these Terms or violation of any law or third-party rights.

14. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any breach of these Terms, including non-payment. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Manatee County, Florida, and you consent to the personal jurisdiction of such courts.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
